As some of you may know from reading my posts, Aquart (custom take company) refuses to give me my $2862.50 back which was a deposit for a monster 750g tank. They never came through with a tank and claim an employee stole the money. The owner won't take any responsibility for the loss and has told me that I'm out of luck. Obviously this doesn't sit very well with me. I'm looking for some help from fellow MFKers. If you are interested please PM me. If Aquart sends me a check, I will donate 25% (thats up to $715.63) to this board. This was my dream tank which turned into a nightmare. Help me stop this crappy company from stealing my money and I will gladly write a check to MFK.

My lawyer feels that it would be a very easy case to win a verdict but collecting the money would be an issue. I might end up spending more money on legal fees than the cost of the tank. I'd rather give the money to this board than lawyers.
I'm asking for help from my fellow fishkeepers. Pm me if you are willing to help. What I am asking for is not very involved.

what did you have in mind?
 
I hope the owner/manager conveyed that an employee stole the money via email. Keep all emails and print them out along with the header (showing aquart's email/ISP). That email can be used as aquart's acknowledgement of receipt of the money. You can take aquart to small claims court since the value is under $5000. This way you can save on attorney's fees since you're representing yourself. Also retain the cancelled check with Aquart listed as the payee. Likewise if it was a M/O. You can order a xerox copy of the cancelled M/O for $12 (takes about 30 days to receive it). If you win, Aquart will have to show the bailiff how they intend to pay. If they haven't paid by the last day of the court order, the court will impose a contempt order and issue a warrant against Aquart. Their assets will be frozen until the court is satisfied that all fines and refunds have been taken care of.

I do have their e-mails confirming acknowledgement of the owner cashing the check and passing it on to the employee 2 weeks later minus his cut. I also have the cancelled check. Small claims will be in the cards if it comes to that but again, I'd rather give the money to fellow fishkeepers than spend it on legal/court fees.

defendant will pay legal and court costs and all you do to get your money is take a lien against the company and then they are f@#$^ED you may not get the money but they will lose credit and lose business do everything you can t make them pay you back they owe you if you have documentation to prove you paid if not your screwed!!!!!
