There are many a greedy people out there who are willing to sue for the sake of payment, no matter how ridiculous we might think. Just look at some of the cases that are being filed. What if someone bought a pacu and it grew to 12 inches in a cramped tank. the fish jumps out and hits the owner in the head? Sounds like a bogus law suit but a possibility.

But where is the liability on the store here?You fish gets too big for your tank,gets stunted and dies prematurely.If you do not know that a Pacu needs a pond,then how do you know how big it actually gets,and how long it should live?

What if someone bought a pacu and it grew to 12 inches in a cramped tank? The BIG, HEAVY fish jumps out and hits the owner in the head? Pacus have large, rock-hard heads. Sounds like a bogus law suit but a possibility. The plaintiff and his attorney argues that "Petsmart never told me that this little fish would grow to a size that would become a danger to me. I now have headaches and suffered a concussion. . . . " Sounds like a lawsuit.

But I wonder if it might have something to do with people releasing them in the wild.
Anyway someone can post what the contratct actually says?

I don't have anything against Petsmart. They're a business. I get their corporate ideology. I was creating a hypothetical situation for the sake of argument, but here's the scary thing about it: They might just win. If you view this from a judicial perspective . . . It does make some sense. Perhaps this would be a Petsmart payback, for all of those poor, little fish that they never taught their customers to properly care for.:D

As for if the fish was an ID or a paroon... bashing the OP as to not knowing "at a glance" what fish it was is just rude. Personally I'de assume it was an ID just because it was at petsmart. But I couldn't tell the difference between these 2 species unless you put one of each in the same tank. They aren't my kinda fish. quit being mean people. Hoyo which store was it? I'm tempted to take a swing just to find out.

It was probably an ID, but they both look very similar at 2-3 inches, so you can see my confusion. ;) But thanks for being an a%$ about it Cichlaholics Anonymous.:)
The store is in Appleton btw.
 
It has to be more of a pledge than anything else.

Like someone else said, there have been stranger suits filed. But I sort of meant "cover one's ass" in a broader sense. I sincerely doubt this "contract" is legally binding in any way. :grinno:

Signing a contract will maybe, just maybe keep that customer from coming back to the store and pitching a fit (or calling corporate to complain) after their monster eats the heater or cracks the glass or tears up the other fish in the aquarium etc etc. This document might also give people pause if they are considering dumping the monster fish back at the store once it has grown too big.

Probably not, but what's the harm in trying? If it doesn't work one bit, who cares; it took two seconds for the customer to sign and cost a fraction of a cent for petsmart to print out the sheet of paper or whatever. *shrug*
