just so u know most tanks are measured with the glass so the glass is counted. and he probably bought the tank being told it was a 35g tank.

You can try and obtain a refund, if not you may want to try civil action. Let
the seller know that you have been in contact with the police to see if that
sways him. If the item offered is fraudulently advertised then the police may
get involved. If the sellers address is in Toronto, then the Toronto Police
Service should be called.
