That won't get you anywhere. They specifically exclude any sort of property damage from their warranty. This would turn into a legal battle exceeding the cost of the tank, and you'd still end up losing:

Just because they state things in their warranty does not make it necessarily legal and binding. My old company used to have things in their terms and conditions that wouldn't have held up in court.

Engineering wise, they are certainly libel for doing their due engineering diligance before producing a product and shipping it out for use. If they can not prove that, and a tank breaks and harms someone, the company could be found responsible.

Have you filed with your credit card? You just need to say that it was not what you paid for, and tell them that you are more than willing to send the product back to the manufacturer in the condition it was received.

And go talk with a lawyer.

If it was a $100 75 gallon tank, I'd say suck it up and take it as a loss.....But this is ridiculous. It's thousands of dollars. And you paid money to get a cadillac of a tank.

They said the tank was perfect when it shipped. The shipper delivered the tank, and somebody signed for it saying it was acceptable. Then a crack appears and the buyer blames the seller. You see the problem here? You'd be fighting a losing battle. I'm not taking Tenecor's side here, I'm just stating like it is, and how things will play out.

it seems like this is whats going to happen. i have wasted enough time with this company and i dont want to bother. money is money but in the end, its tenecor that will be out of business soon. i will sell the 300 tenecor at whatever loss and order a new tank. as stated above, i did not pay by credit card. i should have but oh well. lesson learned. i think i rather show everyone the bad service and terrible quality products they produce so that no one will buy from them on all of the major boards. its honestly their loss for not replacing this tank! now they have fueled the fire im sure to let everyone know of this online. in the end, they are out! not me lol.


i also decided not to fix the tank! why bother... every time i look at this tenecor tank, it will remind me of the drama i had to go through with them. i def wont enjoy looking at the tank for the long run so ill sell it and get a new one! problem solved.

in the meantime, i hope you have all learned from my lesson and spread the word out there!
 
this is not new with Tenecor...I think with mass emails to them and banning them from being a sponsor will do some damage, perhaps not enough but when people spend their hard earn cash to buy professionally build and ship items, you expect nothing less. Those cowards at tenecor will hide until some others here or somewhere else get into the trap of buying bad product from them!.
 
Step 1 - File a claim with the BBB.ORG site
Step 2 - File a claim in smalls claims court for the tank value or the max you can sue for.

They will most likely have their insurnace company settle out of court.

This wasn't caused by shipping and they know it. They are banking on the fact that you will give up and just go away.

Is there even glue under the section that is broken? I bet there isn't which even further proves that the tank was assumbled that way.
 
Tenecor has two employees (or one with two usernames) members of this site - Tenecor and TenecorTanks and they always keep an eye on every thread where the company name pops up. Right now is the time for them to step up and say something about this otherwise their silence will speak pretty loud about how they do business.
 
If I were in this situation, I honestly would consider suing them (and I'm not one of the sue-happy people you hear about). Before I did though, I'd find an expert on acrylic tanks to examine it and tell me if it could be proven that the damage was indeed Tenecor simply creating a bad product and missing it during QA, or if they could get away with saying it was possible to incur that kind of damage via shipping. If you have an expert (you'd have to pay them to make the initial evaluation of course) that could stand up in a court and show why the damage was Tenecor's fault and not the shipper's or yours, then I'd take it to a lawyer...and not before.
 
already filed a claim with BBB. also will be contacting the attorney general's office in phoenix AZ.

i really cant believe that they are pinpointing shipping for their own quality control issue. im sure this thread will deter a lot of potential clients to buy from them.
 
social media and just a good old pounding of emails to them complaining about their ethics and services will do more damage then suing them but that's just me saying that!.. :-) good luck!
