damn thats kinda messed up,but i talked to someone who actually saw the tank with water in it thats the only reason i was going to get it,or the 210 he seemed like a pretty stand up guy did he email you back yet,me personally would not have test filled it on the floor(at least not that size)i would have done it on the stand,but you can never tell what really happened unless you actually saw it burst.(FEEL YOUR PAIN ON THE $650)
 
Ya, thought he was a pretty nice guy too...I drove 3 hours to get it too. I've always been told not to water test it on the stand until you've water tested it on its own...I dunno maybe I should have maybe I shouldn't have...
 
hey if the tank was in tact when it was bought......its kinda your problem now.That sucks man. I was actually gonna buy that tank also.I had dibbs on it b4 it was even listed in a thread.I put up a WTB thread and he replied.I feel bad for you man but it could have been the weather change,the ride home,alot of different factors but never the less,it sucks.Did you water test b4 buying?If you did and it was fine......unfortunately its your loss.
 
Damn man that sucks. I would be PISSED if I was in your shoes. Good thing no one got hurt though.

Trying, and I stress TRYING, cause there is no implied guarantee on a used object unless specified in writing, to sue this guy would be a waste of time, your and the courts.

Everybody wants to sue everybody, that is why our civil court system is so screwed up..............just bringing up sueing in a case like this shows that people have know idea what they are talking about.

c'mon, the tank is clearly not of 'merchantable quality'. that implied warranty goes with everything being sold, even if pre-used unless its being sold on an as is where is basis. I am sure the seller didn't specifically offer our friend with the opportunity of water testing the tank at seller's own place, nor was the tank with water when the buyer inspected. So, the only opportunity that the buyer / poster had to inspect the goods for defects was when he tested the tank in his garage. the defect was clearly patent and led to the tank cracking.

Also, if you see the pics the bottom side is not damaged so I doubt the shimes or uneven pressure had anything to do with the tank cracking. I could be wrong on this latter part though.
 
I never said anything saying I was going to sue or wanted to...lol. I just hope is a nice enough guy to see what this has caused me and give me the 650 back... It would at least cover the dent in my car or some water damage...

give me a legal definition of "'merchantable quality"

you cannot sue using illiterate terms, it defiles the integrity of your case:screwy:

when you purchase any used item, the assumed guarantee, unless specified in writing is "AS IS"

If the seller can prove he had water in the tank prior to delivery, and members here claim they seen the tank with water. That would be the "Merchantable quality" even though I have no idea what that term means, I guess you are looking for.

I take it you have no legal training, please stay in your own profession
 
Sorry the tank busted on you man but I think the seller doesnt owe you anything. It left his possesion in one piece and it was up to you to inspect it before leaving. Maybe it was defective, maybe it was bad luck, maybe test filling it on the concrete floor caused it, but none of these reasons were the seller's fault. Good luck bud.
