haha, not that simple J. It's like someone saying "all this over fogo when you can get practically the same (monos) for $20".

I agree it falls on the seller to provide the product promised, whether or not their supplier provides the seller with what they promise is another story.

Yanker, you can't just yell "SCAM". Your favorite vendor made the SAME mistake. I doubt you'd call him a scammer. Hopefully everything works out for the best.
haha thats why i dont buy into this rare and exotic hoopla. i wont ever spend hundreds/thousands on fogo/xingu etc when i can get orinos and azuls that look better IMO and cost a lot less. im not into showing off my fish based on how rare they are. i show them off based on how bad ass they look ;)

Rclark has put himself in this situation and it's entirely up to him to refund people their money back as he promised. Hopefully there were not too many people who prepaid. I know he had an greement with the vendor too that they would refund his money if they weren't ST's. I don't know how much that is worth but hopefully he had something in writing with them.

So much wisdom from such a little body......

Thanks for the summary but I'm sure WE ALL know how this came about.... things seem so much clearer now that you summed it all up for us.

If you know rClarks post history he doesn't sell much nor does he wheel and deal hustling people for bulk quantities of fish. I think he's sincere in attempting to pass on what was/is a potential deal for fellow forum members. And if it weren't for the last member's exploits regarding the GATF's, he probably wouldn't be getting all this flack.

Besides, unlike the GATF thread I don't see anyone posting how they've been frauded and not issued a refund. So the silence should speak volume.....

+1 :headbang2

one more...let me clarify...i should of said this earlier...i'm talking about blame not what his obligation is.

*he does have an obligation to deliver, yes he does. no doubt about that. i agree 100%...

*but when things go wrong like this, all the blame cant be put on him. it should be spread out with the most blame on him. blame on yourself, blame on distributer/wholesaler/ blame on collector/fisherman.

see how many hands it touches before the seller gets 2 you?

lesson 1: see the fish before you buy...

lesson 2: buy from a reputable vendor.

lesson 3: Too Good to be true.......what you should be thinking when some thread comes along offering an expensive or rare fish for 30 bucks. A fool and his money are soon parted.(had to borrow this sorry)

nice change of opinion, you in politics?

I guess you can say folks go to jail over obligations, not blame.

my opinion still stands, so pls try not to be so one sided and admit it if you prepaid, then its your fault also, along with the seller, his connection and theirs or whoever you want to blame for not knowing any better and not doing the research and not listening to what others were trying to tell the buyers and the seller, but again also dont forget to blame yourself for putting yourself in this situation. but i do agree with you. the seller should pay you back or give you an indo that looks like an ST..

everytime something like this happened to me (and it has), i am pissed and want to blame everyone, especially the seller, but in the end i i'm pissed at me, myself, and i for putting myself there and not doing my research. listen and learned and so i have. and thats what i did for this and thats why i can sit here at ease and say what i want to say knowing that i didnt put my 3k in for a prepay for the ST like i was going to. so now i sit here 3k even instead of 3k less. i'm glad i didnt ..follow me now?

pm me if you want some "imitation" ST's i got some 3 bar wide...:hitting:

seriously, i hope i'm as clear as mudd now on MY OPINION. i'm not going to repeat myself in 10 different ways anymore. it's still your fault also and yes the seller should pay you back.:nutkick::hitting:

Law school and Contracts... In a nutshell, the OP will have to refund any prepaid money. Any legal action against the OP is a sure win--the OP getting scammed himself does not excuse him of any liabilities (the court requires the seller of goods to know better).

:D

As for arguing on the internet over the forums... :screwy:

All this would have been avoided if the thread was closed when the OP posted this for sale. Importations of ST’s are illegal because of the Lacey Act which recognizes all import and export laws of other countries. I posted ad for fully aquatic turtle not even FRT or any other banned species and my ad was closed within 30 mins and I was given infraction for soliciting restricted species. But this ad was allowed to stay open and buyers deposited money. Now everyone is just flaming everyone’s point of view.
