You can but there is a lot of regulations and it is just rough fish. Like min 1000ft from a swimming beach and you have to be fully submerged to do it. Many lakes lack the clarity to be successful. The few lakes that are great for have limited access. There are a few were if you got the junk to ice dive it would be worth it due to monster pikes and catfish. Winter is when you could get them.

As long as your not a f*tard it should be ok everywhere. Since there are complete morons out there they have to regulate it.

Ex. My brother and I were jump shooting ducks. We were in a creek and there was a house far enough away were it wasn't a problem. I told my brother even though it was far enough away the angel could still rain shot on the house so don't shoot at it. Bird gets up, I say in the moment "don't shoot at the house"...bang...then I here the shot raining on the house and the lady comes out yelling. Me being me calmed the lady down and explained my brother is an idiot. All was well after that. He did get a slap upside the head for his reply..."I didn't see it"...

It is because of people like him and how they see what they want to see that everything that can potentially hurt someone not involved gets extra regulations. Spearfishing is no exception. If you knew the people that were spearfishing by the beaches your at you wouldn't be as opposed to it. Since you don't know if they are drunken f*tards you are saying no to it. While I agree that there are other places to do it, clean sand beaches or the edges of them hole some of the best fish. I can't tell you how many huge muskies I have kicked up off the beaches around here as well as huge carp. They like to sun themselves on them. We go around them in off times to get the fish.
