Really what I'm trying to get at is that there are way more people that need to be receiving punishment than have been dealt with; they can't just let a few people who did not witness these acts firsthand take the fall for those who saw Sandusky sexually abusing these kids yet did nothing.

CEO's and folks in charge of organizations have responsibility for anything that happens under their control, war or no war.

You're trying to get him absolved on the basis of the written law in PA? The problem is that there are too many laws on the books
that protects the guilty and not enough to protect the innocents and /or victims!

Paterno or McQueary will probably get off easy based on the letter of the law but they can't escape the moral judgements that will be made on their legacy/records.
 
One thing that does not seem to get much mention of is the fact that Paterno did report to the police commissioner.So,not only did he report what he was told to his superior,he also talked with the top law inforcement officer in the area.
 
i think people who are laying blame on joe pa's foot will never take time to look at the facts and really think this through. i still don't understand why a football coach is being considered the head guy when the case involves a former employee by 3 years. it's no longer a football program problem. it's big picture and the people who concern the big picture were told about what joe pa was told by someone else. i don't think anyone is trying to downplay what happen to the victims. I'm just not sure what we're solving by punishing someone who heard something from someone else, told his bosses since it concerned a former employee and told the police since it involved a crime.

Literal "command responsibility" doesn't apply in this case; that is, only those at the top get punished while those underneath them receive no punishment. Everything I have ever read on the topic of command responsibility has been in relation to war crimes; everyone involved in a non-war crime gets charged with something to varying degrees under domestic laws rather than just the leader(s).

The last time I checked morals ≠ laws. Yes, they may have been morally wrong, but that means absolutely nothing from a legal standpoint.

Exactly. It's really pretty simple to just spend five minutes to look over the timeline of events that a ton of websites have posted now and see what really happened. I think that a lot of people overlook what would have been the case if anyone who reported these incidents to the police and/or their superiors had been wrong; those people would be facing charges, including slander, for such grievous claims.
