Actually it is you that have a poor grasp. You do know police have no legal duty to protect you right? If not them, then why do you think a theater is liable as long as they where following the law? The theater has 0 liability as long as they follow the law. My opinion they should since they made it a gun free zone.

What Im on is the truth. I do not appreciate the attitude but I will chalk it up to being miss informed. Allow me to inform you.

Would you like some more references? Got plenty more court cases. FACT is police have NO duty to protect an individual, that is your responsibility. So if the police lack that duty, what makes you think a theater does? If they where to violate a safety law then yes they could be liable. But as long as they follow the letter of the law they have 0 liability in any way shape or form. That is the truth.
 
This is true, In court, you have no right to expect Police to protect you.
 
the patrons called them emergency exits. How do You know how they were labeled?

because i trust my eyes more then i trust some guy's quote online (the patron, not you). Because a customer assumed it was an emergency exit i should take his word on it? i have a hard time believing theaters all across the country which have checks and balances in place were all off on their building code. pretty sure the fire marshall has paid many a visits

The police arriving sooner does not prevent the guy from unleashing a bulletstorm into the theaters. all we get is potentially different people shot, not the shooting being prevented

I apologize for coming off as having an attituude but, We have gone from talking about the liability of the theater to speaking about expectations of the police. And You are right! No one should expect the police to protect them. I can equally list as many Court cases of people suing a place for percieved safety violations. I can start with the McDonalds hot coffee incident. If You need More a quick google search will counter Your argument of liability 10 fold.

The key to this Balling, Is that You were Not present at that theater. And Im willing to bet that You have never been to it. So Your eyes are not even credible in regards to this arqument. And while the police arriving sooner wouldn't prevent more/less deaths that still doesn't remove the theater from liability. Any time You have a public place where patrons are not allowed to come and go at will, then that creates a responsibility on the establishment.

The "hot coffee" incident is different than expecting the theater to protect you from another individual. The closer association would like I posted. So no, a quick google search will not counter my argument, as there is no counter. If the police are not expected to protect you from other people why would the theater be expected to? If a light fell out of the ceiling and killed 3 people, then yeah the theater would have some measure of liability. Or if the theater had actually made a promise to protect the victims. But unless Im mistaken that never happened.

The theater has 0 responsibility in this case unless they violated the law or made some promise of protection.

It happens all of the time especially with Night Clubs. It is not the Job of a theater to protect it's patrons. It is the Job of the theater to have secure premises. That is why they have Ushers.

If the theater knew in advance that an incident like this was going to take place and didn't do anything to stop it then that would be different, but the shooting was something that couldn't have been predicted and therefor there wasn't any expectations to try to prevent it.

I agree, the coffee incident was a poor example. But anytime that You have a business where People are not allowed to come and go through all exits at will that commits a liability for the owner.
