Damn man! It's nice to hear from you, but this is awful. I hate that bastard! Thank god your son was not in front of it when it blew. A tank that size can kill when it explodes. That's just awful news.

I hope your insurance covers not only the damage to your house, but also replacement of the tank. Your challenge getting the tank covered is going to be whether or not they determine the failure to be caused by faulty worksmanship, which is commonly not covered. If the tank failed because something crashed into it and weakened a seam, that's arguably covered.

As for Mike, the last I heard he bought a pet store in the Atlanta area with the proceeds he got from the sale to Willie. I think I would give him a call. There can't be that many private pet stores in the area. Call the Fulton County business licensing people, and the surrounding counties. There is only 2 or 3. They will be able to give you the name of any business he operates. He sold you a tank with a lifetime guarantee. Fraud carries personal liability, and in most states you can get treble damages. He can't hide behind the corporate shield.

good to hear from you rob! wish it were under better citcumstances..rob and i met through reef central via precision clarity and we both had tank issues with mike coutts, the owner of precision clarity..rob drained his tank before he had the issue i'm having now..rob, i had been watching this tank v ery carefully for any signs of seams splitting or anything (per your advise)but nothing..this tank was built completely of 1" material and it (the acrylic) didnot fail, it was the seams..


from what i gather from an insurance agent/acquatance, they should insure the tank and damage caused by it but they will want a invoice from the manufactuer so corporate can try and recoup their losses..we'll see, as i've said, tomorrow the adjuster comes..i'll say more when i know more..

rob, do you still have your precision clarity tank or did you trash it??
 
If I lived near, I would help clean. Sorry man. I fear one day my tanks will bust open as well. The largest is only a 240 gallon in the garage used, and in light of your situation I think I better keep it there.
 
Very sorry to hear this! Hopefully all damage is covered! And remember...most fish tanks do last.

That is exactly what incorporation does, no personal liabilty for the owner, the business carries all the liability. You have it backwards.

No, I don't have it backwards. You are incorrect. There are a few things that do in fact penetrate the corporate shield and carry personal liability. Unpaid employment taxes are an example. Another is fraud, which I believe was committed on a large scale.

I trashed it. It was a dangerous tank.
 
How is it fraud? You don't commit fraud if you give a lifetime guarantee but it breaks in that lifetime. The fraud is when you don't hold your guarantee, which hasn't happened... yet.

There are MANY locally owned fish stores in metro Atlanta. I can give you a list if you'd like.
