I doubt that will hold up in a court. What's the basis for it? And where do the figures come from? Actual written law?
Read the quote... It's from DMV, doesn't say you have to travel at posted speed limit. It's not written law. It's common sense. Engineer conducts safe speed test annually (you may notice they put a string across the lane, with a box on the shoulder to get the speed count). They don't post the actual safe speed limit, knowing human being tend to travel faster than what they're allowed... We're not perfect, always asking for more... :D I got a ticket 2 years ago, allegedly driving 80 mph at 10pm. Case was dimissed when I contested the charge.

:nilly: :irked: Damn, just wondering those laser guns can really be that accurate !!! Any physicians here can prove they still have errors base on windy, road condition, weather....???
There's a box said "radar" on your ticket. Was it marked "Yes"?

I did read, which is why I asked where you came up with the 83% and 10-15mph. Like I said, I doubt that will work in any court. It's open to too much interpretation, and every judge is different. You might catch them on a good day or a bad day. If you get ticketed for going 66 in a 65, they can most certainly can make you pay the fine. Who makes the determination that exceeding the posted speed limit was safe? The driver? The cop? The judge? Like I said, too much wiggle room. It will come down ot the indvidual judge. Simple as that.

No, it wasnt' marked.
Well I think I need to pay you to be my lawyer. What fishes are you looking for? :naughty::naughty::naughty:

Also I just realize there is a "Safe box" says 0 mph. It means I can only drive at 0mph to be able to eat cookies without getting a ticket. Man, I can't understand the law anymore !!

No, of course you're not telling the judge that posted speed limit is only 83% of actual speed limit. You need to get the current copy of Traffic and Engineering survey for the portion of roadway where you were cited. It will show the actual safe speed limit. ;)

He wanted you to make a complete stop on the freeway! Just go to court. If you dont' have time, post bail, tell the clerk you plead "not guilty," and ask the clerk for the form "Trial By Declaration."

See now that might work. I wonder what the judge would say if I told him some guy on a fish forum said I could drive 17% above the posted speed limit because it's safe

Your Honor will tell you that it sounds fishy to him! Amazing isn't it, the engineer determines the safe speed limit, not the judge, not the cop, not the driver.. :D
